The complaint, announced by Attorney General Pam Bondi and filed by her chief of staff, Chad Mizelle, alleges that Judge Boasberg made "improper public comments" about President Donald Trump and his administration, undermining the integrity and impartiality of the judiciary.
The complaint stems from remarks Boasberg allegedly made during a Judicial Conference on March 11, where he reportedly suggested that the Trump administration would "disregard rulings of federal courts" and could trigger "a constitutional crisis." The Justice Department argues that these comments were unfounded and a diversion from the administrative purpose of the conference.
This formal complaint intensifies the ongoing conflict between Judge Boasberg and the Trump administration, particularly concerning a high-profile case involving the deportation of Venezuelan migrants accused of gang affiliations under the Alien Enemies Act. Boasberg had issued a temporary restraining order on March 15 to halt these deportations and ordered planes already in the air to be returned to the U.S. Despite this, some flights proceeded to El Salvador.
In April, Judge Boasberg found probable cause to hold the administration in criminal contempt, stating that their actions "demonstrate a willful disregard" for his order. This finding, while paused by the D.C. Circuit Court, further fueled the administration's accusations of bias.
President Trump has openly criticized Judge Boasberg, calling him "Crooked" and advocating for his impeachment. This prompted a rare public rebuke from Chief Justice John Roberts, who emphasized that impeachment is not an appropriate response to disagreements over judicial decisions.
The Justice Department's complaint requests that Chief Judge Sri Srinivasan of the U.S. Court of Appeals for the District of Columbia Circuit refer the matter to a special investigative committee. They also seek "interim corrective measures," including Boasberg's removal from the Venezuelan migrant deportation cases and reassignment to another judge.
Judge Boasberg, appointed to the federal bench in 2011 by President Barack Obama and serving as Chief Judge since March 2023, has a history of overseeing high-profile and politically charged cases, including those related to the January 6 Capitol riot, FBI surveillance reforms, and inquiries into Trump's tax returns.
